The Appeals Process
Appellate cases are not actual trials; instead, the appeals process involves challenging a lower court’s decision by presenting a compelling argument to a panel of judges. Generally, the argument takes the form of a brief – a written document – that details the facts of the previous case, explaining legal errors made during the trial. No new evidence or witnesses can be presented to challenge the original decision. Often, success is obtained by demonstrating a violation of the defendant’s Constitutional rights at trial, or by showing that their trial attorney provided ineffective defense.
Our attorney Mr. Abt has significant and relevant experience at raising these issues on appeal. At Abt Law Firm, LLC, we have handled numerous motions for new trials, writs of habeas corpus, and direct appeals of cases throughout the state of Georgia. Mr. Abt has filed appeals all the way to the Georgia Supreme Court, in many types of cases, including by not limited to murder convictions. It is very possible, in such cases, to obtain a new trial or a reversal of the trial court and win the freedom of your family member or loved one.
